60-Day Grace Period
A period after job loss during which an H-1B worker may remain in the U.S. to seek new sponsorship or change status.
About 60-Day Grace Period
<p>Introduced in a 2017 regulation, the <b>60-day grace period</b> allows workers in H-1B (and certain other statuses) to not immediately fall out of status upon termination.</p><p>If an H-1B worker is laid off or resigns, they have up to 60 days or until their petition's expiry (whichever sooner) to either:</p><ul><li>Have another employer file a petition</li><li>File a change of status</li><li>Depart</li></ul><p>During this grace, they cannot work (unless they start at a new employer that filed in the interim), but they can stay legally. It's a one-time grace per validity period.</p>
