About Cap-Subject

<p><b>Cap-subject</b> means the H-1B petition is subject to the congressionally mandated numerical limit (85,000 new H-1Bs per fiscal year for regular + master's caps).</p><p>These petitions:</p><ul><li>Require registration in the March lottery</li><li>Can only start in the next fiscal year (Oct 1)</li><li>Most private sector H-1Bs are cap-subject</li></ul><p>Once a foreign worker is counted in the cap and obtains H-1B status, future petitions for them (transfers, extensions) are cap-exempt as long as they haven't exhausted the 6-year term.</p>
