About Labor Condition Application (LCA)

The LCA (Form ETA-9035) is submitted to the Department of Labor by an employer hiring an H-1B worker. In it, the employer agrees to:

Pay at least the prevailing wage for the position

Offer fair working conditions

Notify employees of the hiring

The LCA must be certified by DOL and then included in the H-1B petition. It's essentially a wage protection mechanism and is valid for up to three years (must cover the entire period of employment).
