GLOSSARY
O-1 Visa
A nonimmigrant visa for individuals of extraordinary ability in sciences, arts, education, business, or athletics.
About O-1 Visa

The O-1 is sometimes considered an alternative to the H-1B for top talents. It requires demonstrating sustained national or international acclaim and recognition in one’s field (through awards, publications, high salary, etc.). O-1 has no cap and can be extended indefinitely in theory, but the criteria are much higher than H-1B. It is also dual intent in practice (though not statutorily like H-1B, USCIS typically allows travel and green card pursuit without denying O-1). Some startup founders or researchers use O-1 if H-1B is not available. The O-1 is employer-sponsored like H-1B, though agents can also petition in some cases.
