Not in compliance with the terms of one's visa status, or beyond the authorized stay.
About Out of Status
<p>An H-1B worker is <b>out of status</b> if, for instance, they stop working for the employer (beyond any grace period) without transferring or changing status, or if their I-94 has expired and no extension was timely filed.</p><p>Being out of status can lead to accrual of unlawful presence (which after 180 days can trigger 3/10-year bars to reentry).</p><p>It's crucial for H-1B visa holders to maintain status by:</p><ul><li>Always having a valid petition/I-94</li><li>Abiding by the employment conditions</li><li>No unauthorized freelancing or working for another entity not on the petition</li></ul><p>The 60-day grace offers a cushion to find a way to stay in status after job loss.</p>
