PERM Labor Certification
The process where the Department of Labor certifies no qualified U.S. workers are available for a job – prerequisite for many employment green cards.
About PERM Labor Certification
<p><b>PERM (Program Electronic Review Management)</b> is the system used for labor certification in EB-2 and EB-3 green card cases.</p><p>The employer must:</p><ul><li>Conduct recruitment for the role</li><li>Demonstrate to DOL that no U.S. worker (citizen or permanent resident) who is qualified and available was passed over in favor of the foreign employee</li></ul><p>Only after DOL certifies can the employer file an I-140 immigrant petition. H-1B visa holders often have PERM filed on their behalf after being hired. The timing of PERM is important for AC21 H-1B extensions beyond 6 years (must be filed by year 5 to get 7th year extension if still pending after a year).</p>
