About RFE (Request for Evidence)

<p>If USCIS isn't fully convinced by the initial H-1B petition, it may issue an <b>RFE</b>. This letter details what's missing or needs clarification.</p><p>Common RFE topics:</p><ul><li>Whether the job is a specialty occupation</li><li>Proof of the beneficiary's degree</li><li>Additional documentation requirements</li></ul><p>The petitioner must respond by the deadline (usually 87 days) with the requested evidence. After USCIS receives the RFE response, they resume processing and then approve or deny the case. RFEs are common in H-1B cases, but with a strong initial filing, they can often be avoided.</p>
